PARTICIPATION IN THE SLEEPSCORE AMP YOUR RESOLUTION GIVEAWAY! PROMOTION REQUIRES ACCESS TO INTERNET SERVICE. NO PURCHASE NECESSARY TO PARTICIPATE OR TO RECEIVE A GIFT. THIS IS NOT A SWEEPSTAKES AND DOES NOT INVOLVE A RANDOM DRAWING TO DETERMINE RECIPIENTS OF THE GIFT.

 

The AMP Your Resolution Giveaway! (the “Promotion”) is sponsored by Consumer Sleep Solutions LLC, DBA SleepScore Labs™ (the “Sponsor”), with offices located at 2175 Salk Avenue #140, Carlsbad, CA 92008

 

1. ELIGIBILITY: The Promotion is open to legal residents of the 50 United States, the District of Columbia (“D.C.”), Puerto Rico and Canada who are at least eighteen (18) years of age at the time of joining the AMP Your Resolution Program (“Program”). Officers, directors and employees of Consumer Sleeps Solutions LLC, DBA SleepScore Labs™, and members of the immediate families (defined for these purposes as including parents, grandparents, children, grandchildren, siblings, and each of their respective spouse) or households (whether related or not) of any of the above, are NOT eligible to participate. The Promotion is subject to all applicable federal, state, and local and international laws and regulations. Participation constitutes the consumer’s full and unconditional agreement to these Official Rules and Sponsor’s decisions, which are final and binding in all matters related to the Promotion. Void in the U.S. Virgin Islands, U.S. Military installations in foreign countries, and where prohibited, taxed, or restricted by law.

 

1. PROMOTION PERIOD: The AMP Your Resolution Giveaway! Promotion begins 9:00 a.m. Eastern Standard Time (“EST”), January 7, 2019 and ends when 10,000 participating consumers have been awarded the Voucher Code (“Voucher Code”) for a free 6-month subscription to SleepScore App (the “Promotion Period”).

 

III. SLEEPSCORE APP GIFT: The first ten thousand (10,000) Participants who have successfully enrolled into the AMP Your Resolution Program are to receive, via the Participant’s provided e-mail address, a Voucher Code for a free six-month premium subscription to the SleepScore App Gift (“SleepScore App Gift” or “Gift”). MSRP is $34.99 each (USD)

 

1. HOW TO PARTICIPATE: Dr. Oz Show viewers and the general public are deemed a Participant (the “Participant” or “you”) when you visit www.doctoroz.com and follow the prompts to the SleepScore AMP Your Resolution Giveaway! landing page (https://www.sleepscore.com/new-years-resolution/). Scroll down to the Join the AMP Your Resolution Program enrollment form. Participants are required to provide a complete name, e-mail address and verify they are eighteen (18) years of age or older. Please respond to the Chose Your Resolution questions. Upon completion click on the Subscribe button. The information provided on the enrollment form will be considered your submission (“Submission”). Upon completion of Submission, Participants receive via the provided e-mail address a 10% discount voucher code (“Discount Code”) to the SleepScore Store, and a Voucher Code for a 6-month free premium of the SleepScore App (“SleepScore App” or “App”). Then simply download the App via the App Store or Google Play Store and redeem the Voucher Code through the provided link to receive the 6-month free premium SleepScore App.

 

All requested information must be provided to be eligible to be enrolled into the Program. Incomplete forms will be voided. Sponsor reserves the right, in its sole discretion, to void any and all Submissions of a Participant that uses multiple / different addresses, identities, or any other methods, or who Sponsor believes has attempted to tamper with, influence or impair the administration, security, fairness, or proper play of this Promotion. All Submissions or any other correspondence with Sponsor or Administrator become the exclusive property of Sponsor and will not be acknowledged or returned.  Use of robotic, automatic, mechanical, programs or similar processes to enter information and promo codes are ineligible and will be disqualified.  Sponsor reserves the right to disqualify and/or block access to the Website by any individual suspected of using such processes. In the event of a dispute as to the identity of a Winner based on an e-mail address, the winning entry will be declared made by the authorized account holder of the e-mail address submitted at time of Submission. “Authorized account holder” is defined as the natural person who is assigned to an e-mail address by an Internet access provider, on-line service provider or other organization (e.g., business, educational, institution, etc.) that is responsible for assigning e-mail addresses for the domain associated with the submitted e-mail address.

 

1. NOTIFICATIONS: A confirmed enrolled Program Participant will receive a Notification e-mail (“Notification E-Mail” or “Notification”) with the Voucher Code for the free six-month premium subscription to the SleepScore App Gift. If any Participant’s e-mail provider indicates that the e-mail is invalid or unable to receive the communication (even if ultimately delivered thereafter), the Voucher Code will be forfeited and an alternate Participant will be contacted via their provided e-mail. Falsification of information on the enrollment form that was completed by a Participant will be grounds for ineligibility and/or the SleepScore App Gift forfeiture. Upon forfeiture for any reason stated in these Official Rules, no compensation will be given except at the sole discretion of Sponsor.

 

Any one of the first 10,000 Program Participants will not be eligible to receive the SleepScore App Gift until the Participant has been verified in accordance with these Official Rules, and the Participant has fully complied with these Official Rules. Failure to comply with these Official Rules may result in disqualification from the Promotion.

 

1. SLEEPSCORE APP GIFT TERMS CONDITIONS: The value of the SleepScore App may be taxable as income and each Participant is solely responsible for all matters relating to the SleepScore App Gift, including, but not limited to all applicable federal, state and local taxes that become due with respect to the SleepScore App Gift.Should a Participant who has their primary residence outside the United States, win the SleepScore App Gift, will be required to abide by United States law, regulations, and tax requirements. The SleepScore App may not be sold, traded, or commissioned, and is not exchangeable, transferable, or redeemable for cash except in Sponsor’s sole discretion. The ten thousand (10,000) SleepScore Apps availability is subject to change. There are no substitutions unless specified by the Sponsor. The Sponsor is not in any way responsible or liable for damages resulting from downloading loss, use or misuse of any SleepScore App Gifted in this Promotion. Unclaimed or an undeliverable SleepScore App will not be awarded after six (6) months of the Notification date that appears on the Notification e-mail. return or refusal of any SleepScore App as undeliverable will similarly disqualify the Participant and the next eligible Participant will be notified.

 

VII. PRIVACY AND OPT-OUT: Participation in the Promotion, each Participant will hereby authorize the Sponsor the right to obtain, use, process, transfer and store all data provided by you, including without limitation, personal data, and with such party(ies) as Sponsor deems appropriate, for purposes of administration of the Promotion. All information submitted to the Sponsor as part of this Promotion will be treated in accordance with the Sponsor’s privacy policy, available at (http://www.sleepscorelabs.com and be used by the Sponsor to administer the Promotion. By entering the Promotion, Participants have the right to access, withdraw, and correct their personal data, and may opt out of receiving future e-mails from Sponsor by clicking on the link contained in any e-mail received. Participant will remain eligible for this Promotion whether or not you opt out of receiving the e-mails.

 

VIII. PUBLICITY. A Participant’s acceptance of the SleepScore App Gift constitutes permission (except where prohibited) for the Sponsor and its advertising and promotional agencies, and providers and those acting under their permission, the irrevocable and perpetual right to use  to participate in any media or promotional activity, as reasonably requested and use said Participant’s name, city, state (only), likeness, voice, comments, interviews and any photographs or video or audio footage for advertising and publicity purposes without payment of additional consideration, except where prohibited by law.

 

1. LIMITATIONS OF LIABILITY: If for any reason this Promotion is not capable of running as planned for any reason, including, without limitation, due to infection by computer virus, worms, bugs, tampering, unauthorized intervention, fraud, technical failures, fire, flood, storm, or other natural cataclysm, riot, strike, civil commotion, government regulation, or any other causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity or proper conduct of this Promotion (or any part thereof), the Sponsor reserves the right, in its sole discretion, to disqualify any individual who tampers with the entry process, and to terminate, modify or suspend the Promotion, in whole or in part, at any time, without notice or awarding the SleepScore App, using all non-suspect eligible Participants received as of or after (if applicable) this termination or suspension date. Sponsor assumes no responsibility for any incomplete, incorrect, or inaccurate information, whether caused by Website users, tampering, hacking, or by any of the equipment or programming associated with or utilized in the Promotion or by any technical or human error. Sponsor also assumes no responsibility for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, Participants. The Sponsor is not responsible for any problems or technical malfunction of any telephone network or telephone lines, computer on-line systems, servers, or providers, computer equipment, software, failure of any e-mail or entry to be received by Sponsor on account of technical problems, human error or traffic congestion on the Internet or at any Website, or any combination thereof, including any injury or damage to Participant’s or any other person’s computer (or any information/material stored therein) relating to or resulting from participation in this Promotion, or downloading any materials in this Promotion. Any person who supplies false information, obtains entries by fraudulent means or is otherwise determined to be in violation of these Official Rules in an attempt to obtain any Gift will forfeit any Gift received and may be prosecuted to the full extent of the law. CAUTION: ANY ATTEMPT TO DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE PROMOTION IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE THE SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES OR OTHER REMEDIES FROM ANY SUCH PERSON(S) RESPONSIBLE FOR THE ATTEMPT TO THE FULLEST EXTENT PERMITTED BY LAW.

 

1. RELEASES: As a condition of participation in the Promotion, Participants agree to indemnify, release and hold harmless the Sponsor from and all liability, claims, damages, injuries or actions of any kind whatsoever for injuries, damages, or losses to persons or property which may be sustained in connection with: (a) participating in any aspect of the Promotion; or (b) the receipt, ownership, possession, use or misuse of any Gift.

 

1. GOVERNING LAW/DISPUTES: By enrolling in the Promotion and Program, Participants agree to be bound by the Official Rules, Sponsor’s Website Terms of Use (if any and if applicable to Participant’s method of participating), and the decisions of the Sponsor, which are final and binding in all respects. Except where prohibited, Participant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Promotion or any Gift offered shall be resolved individually, without resort to any form of class action, and any judicial proceeding shall take place in a federal or state court in San Diego, California; (2) any and all claims, judgments and Gifts shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Promotion, but in no event legal fees; and (3) under no circumstances may the Participant obtain Gifts for, and Participant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Participants or Sponsor in connection with the Promotion, shall be governed by, and construed in accordance with, the laws of the State of California without giving effect to any choice of law or conflict of law rules (whether of the State of California or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of California.

 

XII. APP RECIPIENT LIST/OFFICIAL RULES REQUEST: For the names and city/state of residence of SleepScore App or a copy of these Official Rules, send a request specifying a copy of the App Recipient List or Official Rules along with a self-addressed, stamped envelope postmarked by 12/31/19. XIV. MISCELLANEOUS: The Dr. Oz Show is not a sponsor of this Promotion. However, the Dr. Oz Show has authorized, sanctioned and agreed to this Promotion and the use of the Dr. Oz name and/or the Dr. Oz Show for the purposes set forth herein. The names of individuals, groups, companies, products and services mentioned herein, and any corresponding likenesses, logos and images thereof reproduced herein, have been used for identification purposes only and may be the copyrighted properties and trademarks of their respective owners. The mention of any individual, group or company, or the inclusion of a product or service as a prize, does not imply any association with or endorsement by such individual, group or company or the manufacturer or distributor of such product or service and, except as otherwise indicated, no association or endorsement is intended or should be inferred. The invalidity or unenforceability of any provision of these Official Rules will not affect the validity or enforceability of any other provision.  In the event that any provision of the Official Rules is determined to be invalid or otherwise unenforceable or illegal, the other provisions will remain in effect and will be construed in accordance with their terms as if the invalid or illegal provision were not contained herein.  Sponsor’s failure to enforce any term of these Official Rules will not constitute a waiver of that provision.  For Participant, to the extent there is a conflict between these Official Rules appearing any other location and any terms of use or other agreement posted on the Sponsor’s Website, these are the Official Rules to be abided by.
